The New Jersey Safe Act
The New Jersey Safe Act (effective October 1, 2013), provides certain eligible employees with an unpaid absence to address circumstances resulting from domestic violence or a sexually violent offense. The unpaid absence is for a period not to exceed 20 days in a 12-month period. To be eligible, the employee must have worked at least 1,000 hours during the immediately preceding 12-month period.
For eligible employees who have accrued paid time off (PTO) or vacation time may be used for otherwise unpaid New Jersey Safe Act leave, provided that you comply with PTO or vacation policy requirements. The application of paid time off or paid vacation time off for unpaid leave does not extend the 20 days within a 12-month period. If the employee requests leave for a reason covered by both the NJ SAFE Act and the New Jersey Family Leave Act, or the federal Family and Medical Leave Act, the leave shall count simultaneously against the employee’s entitlement under each respective law.Read More
